Boo Freakin' Hoo

Look upon the face of the poor, oppressed, tragic, hard-working, innocent, taking-the-job-no-American-will-take undocumented worker, Nicky Diaz Santillan. Oh, the horror of it all. I think I hear sad violins playing.

Republican gubernatorial candidate Meg Whitman forced dear Nicky to enter the country illegally, obtain fake work documents, sign untrue legal documents under penalty of perjury at an employment agency, secure a California driver's license, obtain a phony Social Security number and then further tormented this sweetie by paying her $23 per hour plus benefits.

The more I see of this kind of baloney as we get closer to election day, the more I feel the necessity to rant. The more I learn about this border-hopper, the angrier I get. I'm ticked at her and her crocodile tears, and I'm ticked at the amazing number of allegedly intelligent people who are buying her ridiculous tale of woe. I'm ticked at the surprising number of people who somehow think that Whitman is an ogre for hiring her, or firing her, or failing to move heaven and earth to "help" her. Nicky, honey, you made your bed, now you can bloody well lie in it.

Most people have seen or read about the sudden appearance on the scene of the obnoxiously litigious and hellishly publicity-grabbing lawyer Gloria Allred. This ambulance-chasing publicity hound tossed Nicky at the cameras a few days ago to ambush Whitman while at the same time risking her client's deportation (though given the Obama administration, that's pretty low risk). The tears. The agony. The purposeful conflating of present, past and future tenses in broken English designed to draw sympathy while at the same time avoiding the truth by making it sound like Whitman "she not helping me" from the very beginning.

Little Nicky has lied to everyone since sneaking into the United States, but now we're somehow supposed to believe every bit of her heart-rending sob story. Aw, horse manure. She's a liar, a criminal, a perjurer, a sneak, a very bad actor, and most of all, she's a damned ingrate. Big-mouth Allred pulled all the strings, obfuscating, dramatizing, claiming things that are simply not true, and generally being the pain-in-the-ass she's always been. She tried to paint little Nicky as the victim. Sorry, Gloria. Whitman's the victim, and you're the mouthpiece for the ambushing little liar who, with your assistance, is trying to skew the electoral process in California.

Little Nicky actually has a lawyer who didn't seek the headlines, and she had that lawyer before Glorious Gloria grabbed the headlines with the mission of assisting Democrat Jerry "Moonbeam" Brown in attempting to win the gubernatorial election and screw up the legal system the way he did the first time he was governor. Gloria Allred made her career pursuing insane cases in California successfully, with the help of the California Chief Justice appointed by Jerry Brown. Chief Justice Rose Bird (and two of her crazy fellow justices) were removed from the Supreme Court bench by the voters after a lengthy series of crazed decisions, some of which favored Allred's way of thinking.

Marc Van Der Hout is Little Nicky's immigration counsel. He is from San Francisco (where else?), and has been trying for some time to get legal status for poor Little Nicky. Nicky was referred to him by another attorney, though Van Der Hout won't say who that attorney is. I can guess who that mystery attorney was, but we're not here to speculate. Van Der Hout is a leftist, no-borders, to hell with sovereignty kind of guy. But at least he's not a publicity-hound like Allred. He does try to deflect the obvious conclusion about the referral by saying "I think someone referred her [Little Nicky] to Gloria on the matter of hours and back pay as well."

Well, there's some truth to that. Poor Little Nicky (through Allred) is claiming she was "abused" by being paid only $23 per hour for 15 hours per week when she actually had to work 18 hours a week and occasionally pick up kids at school. That sounds like the kind of job that millions of unemployed Americans would take. And it's what we lawyers call "a naked allegation." But instead of talking to Whitman first, or merely filing a wage claim, Allred had Little Nicky go public and admit she's in the country illegally. Oh, and the wage claim Allred filed for Little Nicky has a blank box where a legitimate Social Security number belongs. Hmmmmm.

So, Whitman's the bad-guy and poor Little Nicky is the tragic victim. How so? Well, after working under false pretenses for Whitman for years at a ridiculously high rate of pay for a housekeeper, Nicky decided she'd use Whitman's prominence to undo her lies and illegal status. Horror of horrors, instead of assisting in perpetuating the lies and deception of an illegal alien, Whitman told Little Nicky that she could no longer employ her. She wished her well, and sent her on her way.

Not only did Little Nicky continue to live illegally in California, but attorney Van Der Hout refuses to say how she has supported herself and her family since Whitman let her go in June of 2009. Certainly it isn't off the future expectation of collecting on her wage claim against Whitman which totals the monumental figure of about $6,000.

So let me sum up my opinion of Whitman's big scandal. The day Little Nicky tried to coerce Whitman into assisting her illegal presence in California, Whitman should have said: "You're fired, you little sneak, and furthermore, I'm calling La Migra right now to have you deported." But this horrible woman, this exploiter of the low and innocent, Meg Whitman, softly said that she simply couldn't continue to employ her any longer, but had the human empathy for a longtime employee that kept her from reporting Little Nicky to the feds.

Allred claims that Little Nicky is very intelligent, and made all the decisions about going public herself. Well clearly Nicky isn't intelligent enough to know she's being used as a political tool and a sacrificial lamb. Jerry Brown and Gloriana both deny that there's any connection to the gubernatorial race. That may be true, but I doubt it. When asked about the Brown-Allred-Diaz connection on Fox News Channel, comedian/pundit Dennis Miller replied that he wouldn't put anything past Jerry Brown since "Brown has been sucking at the public teat since the day he was born 72 years ago. Jerry, get a real job!" In fact, the Browns, pere et fils have been continuously in California public office since 1946.

Griff Harsh, the husband of California gubernatorial candidate Nutneg Whitman, acknowledged in a statement on Thursday that “it is possible” he received and wrote notes on a letter from the Social Security Administration back in 2003, regarding the former housekeeper. The Whitman/ Harsh household then fired their housekeeper in June 2009 (after nine years of service), when Nutmeg handlers decided that she was an election liability. And now the Nanny backs up the Maid, so sweet.

Meg, Meg, Meg, where do I start, you have reportedly spent $140 million of your own money to get elected Governor but you couldn’t use some of it to get your housekeeper (after nine years of service) some legal help to get her papers, and worse you lied about it. Wow, what a WITCH, of course I meant it with a “B”.

But your comments on holding employers accountable for hiring undocumented workers real takes the cake, I assume you exempt yourself and your husband, or will you be turning yourself in.

Meg you think you can buy the election, but what puzzles many is if you real cared and loved California then why not do your civic duty and vote, seems more rhetoric than anything else.

In good times we might give you a try but not in our disaster mode that we find ourselves in after that so-called outsider Independent Republican, named Arnold Schwarzenegger (sold to us by radio personalities John and Ken), ruined our state, yah we will trust another one of you liars, think not. And another thing nine years this maid was in your house, in your house and you failed to learned this major thing about her, come on this sounds like a huge lie that no one can believe in.

Ebay paid out $200,000 because Nutmeg assaulted an employee, so it’s not the first time she has mistreated an employee. Good luck winning Nutmeg, money will buy you admiration from the majority just from the Gay Old Party (GOP), but not from all of California.

LawHawk,

Brown must be getting desperate with this last attempt. The only ones buying it are drunk posers like Montana here.

California is crazy if they would go back to Jerry Brown.

Certainly to goodness the people of California are not that stupid, and then we see Montana’s rant, and my suspicions are confirmed.

Great read as always Lawhawk.

rlaWTX, It kind of brings a tear to your eye doesn't it? Actually, this isn't our first troll. But they have tended to come very late to the articles they've hit, so no one has seen them. This is the first to rush here to hit an article, and it's so well prepared with youtube links and other Moonbeam propaganda that I suspect "Montana" is probably a paid Democratic operative. We've had those show up too.

Should we offer Montana a beverage and some snacks?

Montana: Thanks for sharing. Her husband got an inquiry, not a statement, and he asked Little Nicky about it. She denied it, and kept the note. Sorry, she got fired when, and only when, Meg Whitman actually knew about it. And besides, shouldn't you be happy that Whitman hired an illegal? I get the distinct impression you think they should just stick around until the next amnesty.

Try getting your news from somewhere other than MSNBC, and start facing the real world instead of your happy, happy, kumbaya world. Good talking points, though. Where did you get your script?

Everything coming out of the Little Nicky camp is pure speculation and naked allegations. Allred won't answer a direct question, and when she responds at all, it's to add another unproven accusation. This thing can't possibly be fully investigated, let a lone litigated, until after the November election. And that, of course, is the entire point of the ambush.

Joel: I've seen so many of these last-minute hit pieces that I ordinarily ignore them. But there was just something particularly unsavory and downright annoying about this one. There's just that small kernel of truth to the story (Little Nicky is, after all, an illegal immigrant) that it gave the Allreds of this world a chance to exploit their own little favorites solely for a political gain.

rlaWTX: As trolls go, Hannah Montana was pretty mild. It always upsets these guys or gals when a self-funder spends almost as much as the union goons. She's rich--she must be evil. Little Nicky is poor--she must be good. Well, at least they're consistent.

Tennessee: I could write an entire book just on the damage Jerry Brown and his airy-fairy team did just to the legal profession and California jurisprudence. And one of the ambulance-chasing success stories from the Jerry Brown era is Gloria Allred. Two peas in a pod, except she at least has a personality (however obnoxious). Jerry Brown is a chameleon, and nobody can actually figure out where he stands on anything. I think that includes Jerry Brown himself.

Stan: Liberals simply can't understand that a half-truth is a lie in most situations. Little Nicky is an illegal immigrant who worked for Meg Whitman (under false pretenses). True. Everything that follows that truth is either a half-truth or a lie. Whitman exercised due diligence in the hiring, and undeserved mercy after terminating the illegal's services (no report to the feds). Allred was unable to answer the question about the spurious wage claim which addressed the mysterious disappearance of the purloined Social Security number contained on the original job application. Even that took nine years for the Social Security Administration to question. I guess Whitman was supposed to devote her entire career to checking out Little Nicky's fraudulent papers.

Andrew: At least the union thugs used a legal whore to advance their cause instead of the usual baseball bats and fists. The SEIU desperately needs the Little Nickies to expand their dues base, and the Democrats desperately need "instant citizens" to keep them in power.

Bev: Yes--I suggest an absinthe cocktail with a hemlock chaser.

LawHawk,

I did notice. I also noticed he didn't endorse Brown. Just gave dirt on Whitman. Which means he really doesn't know Brown. Brown was out because he was hated by both sides of the aisle.

Joel: Brown is like Dracula. He keeps rising from the grave. The most common expression for him the last time he ran for statewide office was "flaky." That's as good as anything I can come up with. His entire agenda is based on whether he had a good bowel movement this morning. The liberals have almost as much to fear from him as the conservatives. This is his swan song, so the only group that he has heretofore been loyal to is the unions that provide him with his biggest campaign funds. Since this is likely to be his last run for office, he'd just as easily sell them out too if it guaranteed his "legacy." At least he doesn't have any kids, so we don't have to worry about a third generation of Browns in office.

Deport the maid. End her pain in the US. Send her back to her people.

LL: We can't do that. She's living the American dream--doing a menial task, getting paid handsomely for doing it even though she doesn't deserve it, getting away with living on forged documents, and then hiring a shyster lawyer to make her illegal activity go away while getting her big bucks for not being overpaid enough for her mindless, talentless work.
